      Modul de departajare a ofertelor cu preturi egale:

      In situatia in care doi sau mai multi ofertanti situati pe primul loc au acelasi pret, autoritatea contractanta va solicita clarificari, prin intermediul SEAP la rubrica „Intrebari”, la care operatorii economici vor transmite online o noua propunere financiara (maxim 2 zecimale).

      Elementul care face obiectul reofertarii este pretul. Contractul va fi atribuit ofertantului a carui noua propunere financiara are pretul cel mai scazut. In cazul in care si in urma reofertarii preturile ofertate sunt egale, atunci autoritatea contractanta va solicita o noua oferta de pret, pana cand departajarea va putea fi posibila.

      Comunicarea rezultatului procedurii — conform prevederilor Legii nr. 98/2016.

      Modul in care se poate accesa DUAE in vederea completarii de catre operatorii economici interesati: https://ec.europa.eu/growth/tools-databases/espd/filter. Documentul atasat DUAE va fi semnat cu semnatura electronica extinsa, bazata pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat fara a i se diminua raspunderea în ceea ce priveste modul de îndeplinire a viitorului contract, conform art. 54 din Legea 98/2016 privind achizitiile publice, ofertantul are dreptul de a include în propunerea tehnica posibilitatea de a subcontracta o parte din contractul respectiv.

      Modificarea contractului de achizitie publica, in cursul perioadei sale de valabilitate, se face in conditiile prevazute la art. 221 din Legea nr. 98/2016. Modificarea contractului in cursul perioadei sale de valabilitate, altfel decat in cazurile si conditiile prevazute la art. 221 din Legea nr. 98/2016, se realizeaza prin organizarea unei noi proceduri de atribuire, in conformitate cu dispozitiile legii.
