      (b) În cazul în care doi sau mai multi ofertanti clasati pe locurile 2 au preturi egale, se va se va aplica aceeași procedura prin intermediul SEAP, ca la pct. a). Noile oferte financiare nu pot fi mai mici decât pretul ofertat de op. ec. clasat pe locul 1,

      (c) În cazul în care doi sau mai multi ofertanti clasati pe locurile 3 au preturi egale, se va se va aplica aceeasi procedura prin intermediul SEAP, ca la pct. a). Noile oferte financiare nu pot fi mai mici decât pretul ofertat de op. ec. clasat pe locul 2. Autoritatea contractanta isi rezerva dreptul de a rezilia unilateral acordul cadru inainte de termen, in cazul in care Ministerul Sanatatii va incheia in baza OUG 71/2012 acorduri-cadru avand ca obiect produsele din prezenta procedura.
