      Interactiunea cu ofertantii, respectiv procesul de evaluare a ofertelor se va desfasura dupa urmatoarele reguli:

      Pentru vizualizarea documentatiei de atribuire încarcate în SEAP, este necesar ca operatorii economici sa detina/instaleze pe statia de lucru, aplicatia care permite verificarea semnaturii electronice si vizualizarea documentelor semnate electronic (disponibile pe site-urile furnizorilor de semnatura electronica).

      Pentru transmiterea solicitarilor de clarificari privind documentatia de atribuire, operatorii economici se vor înregistra în SEAP (www.e-licitatie.ro) ca operator economic conform prevederilor art. 5 alin. (1) din H.G. nr. 395/2016 si vor transmite solicitarile avand în vedere termenele de raspuns ale autoritatii contractante prevazute la art. 160–161 din Legea nr. 98/2016.

      Ofertantul va elabora oferta in conformitate cu prevederile din documentatia de atribuire si va indica in cuprinsul acesteia care informatii din propunerea tehnica si/sau din propunerea financiara sunt confidentiale, clasificate sau sunt protejate de un drept de proprietate intelectuala.

      Oferta are caracter obligatoriu, din punctul de vedere al continutului, pe toata perioada de valabilitate stabilita de catre autoritatea contractanta si asumata de ofertant. Comisia de evaluare are obligatia de a stabili oferta câstigatoare, dintre ofertele admisibile, pe baza aplicarii criteriului

      Pentru atribuirea contractului de achizitie publica. Oferta câstigatoare stabilita de catre comisia de evaluare va fi oferta cu cel mai scazut pret.

      Înainte de atribuirea acordului-cadru autoritatea contractanta solicita ofertantului clasat pe primul loc dupa aplicarea criteriului de atribuire sa prezinte fara intarziere documente justificative actualizate prin care sa demonstreze indeplinirea tuturor criteriilor de calificare, in conformitate cu informatiile cuprinse în DUAE. DUAE poate fi accesat in vederea completarii de catre operatorii economici interesati la urmatorul link: https://ec.europa.eu/growth/tools-databases/espd/filter.

      Modul de departajare al ofertelor clasate pe acelasi loc: In cazul in care, in urma stabilirii clasamentului final conform criteriului de atribuire „pretul cel mai scazut”, comisia de evaluare constata ca sunt doua sau mai multe oferte cu acelasi pret, autoritatea contractanta va solicita operatorilor economici in cauza, printr-o clarificare transmisa prin SEAP la sectiunea „Intrebari” (in vederea incarcarii electronice de catre operatorii economici de documente care contin preturi noi, o noua propunere financiara) pe baza careia vor fi departajati. Reofertarea se face doar pentru loturile la care va exista aceasta situatie. Elementul de departajare va fi pretul mai scazut. Daca in urma reofertarii, preturile raman egale si nu se poate face departajarea, lotul va fi anulat. Se admit, in cadrul reofertarii, preturi unitare cu trei zecimale.

      Pe parcursul procesului de reofertare, autoritatea contractanta poate solicita clarificari cu privire la documentele primite de la ofertanti, fiind incidente dispozitiile alin. (1) art. 136 din HG 395/2016. Orice comunicare, solicitare, informare, notificare si altele asemenea vor fi încarcate în SEAP si vor fi semnate cu semnatura electronica extinsa, bazata pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat în conditiile legii.
