      Modalitatea de departajare a ofertelor clasate pe primul loc cu preturi egale: in cazul in care se constata ca ofertele clasate pe primul loc au preturi egale, autoritatea contractanta va solicita clarificari prin intermediul SEAP, in vederea incarcarii electronice de catre operatorii economici de documente care contin noi preturi. In cazul in care egalitatea se mentine autoritatea contractanta va solicita cate o noua clarificare pana la departajarea ofertantilor sau pana cand toti operatorii economici nu mai reoferteaza. In cazul reofertarii, in vederea departajarii ofertantilor clasati pe primul loc cu preturi egale, autoritatea contractanta va accepta exprimarea preturilor unitare in RON fara TVA, cu maximum 3 zecimale.

      Livrarea produselor se va face in termen de 5 zile de la lansarea comenzii, sau, in cazuri de urgenta, in termen de 72 de ore de la primirea acestora.

      Semnarea contractului subsecvent se va face in termen de maxim 3 zile lucratoare de la data primirii acestuia de la achizitor.

      Conditii de transport: Produsele vor fi transportate la sediul spitalului – farmacie, trasportul fiind asigurat de catre firma câstigatoare. La livrare, produsele vor corespunde cantitativ, calitativ si valoric comenzii transmise iar la constatarea la receptie a unor vicii ascunse receptia nu se va face pana la rezolvarea acestor probleme.

      Modalitati de plata: Plata facturilor se face prin ordin de plata in conformitate cu prevederile legale, în termen de maxim 60 de zile de la primirea facturii.

      Cantitatile minime si maxime stabilite in prezenta documentatie, reprezinta estimari ale unor cantitati care ar putea fi solicitate pe durata intregului acord cadru si nu cantitatile exacte care vor fi achizitionate de catre autoritatea contractanta.

      Autoritatea contractanta isi rezerva dreptul de a achizitiona cantitatea in functie de necesitatile efective, nefiind obligata la cantitatea minima prevazuta.

      Autoritatea contractanta isi rezerva dreptul de a rezilia unilateral acordul cadru/contractele subsecvente inainte de termen, in cazul in care Ministerul Sanatatii va incheia in baza OUG 71/2012, cu modificarile si completarile ulterioare, acorduri-cadru/contracte avand ca obiect produsele din prezenta procedura.
