      In situatia încheierii unui acord-cadru cu mai multi operatori economici, fara reluarea competitiei, atunci cand doua sau mai multe oferte au preturi egale si sunt clasate pe acelasi loc, in vederea departajarii, pentru a fi atins numarul maxim de operatori economici cu care se doreste a fi încheiat acordul-cadru, autoritatea contractanta va mentiona modalitatea de departajare, fara ca acest lucru sa afecteze pozitiile superioare in clasament ocupate de ceilalti ofertanti.

      Pentru fiecare lot in parte: In cazul ofertelor de pret egale (doua sau mai multe oferte) si clasate pe acelasi loc, modul de departajare intre oferte se va face prin reofertarea preturilor. Pretul reofertat nu poate fi îmbunatatit decât pâna la nivelul pretului ofertat de operatorul clasat pe locul anterior.

      In cazul in care comisia de evaluare constata ca au fost depuse oferte admisibile cu preturi unitare egale la ofertantii clasati pe primul loc, autoritatea contractanta va solicita o noua propunere financiara in plic inchis, caz in care contractul va fi atribuit ofertantului a carui noua propunere financiara are pretul cel mai scazut. Noile propuneri financiare se vor depune in SEAP.

      Prezentul acord-cadru se reziliaza pe deplin drept in eventualitatea realizarii licitatiei în conformitate cu O.U.G. 71/2012, efectuata de Ministerul Sanatatii la nivel national.
