      Notă: în cazul în care în urma aplicării procedurii de atribuire „prețul cel mai scăzut", avem două sau mai multe oferte cu același preț, se va solicita ofertanților care au oferit preț egal să depună o nouă ofertă în SEAP. DUAE poate fi descărcat în vederea completării și depunerii de la adresa https://ec.europa.eu/growth/toolsdatabases/espd/filter (instrucțiuni privind completarea DUAE sunt disponibile la adresa www.elicitatie.ro). Înainte de atribuirea contractului, autoritatea contractantă va solicita ofertantului clasat pe primul loc după aplicarea criteriului de atribuire, să prezinte documentele justificative actualizate prin care să demonstreze îndeplinirea tuturor criteriilor de calificare, în conformitate cu informațiile cuprinse în DUAE. DUAE se va depune, după caz și de către terțul susținător. În cazul operatorilor economici străini, se vor prezenta documente echivalente emise în conformitate cu legislația aplicabilă în țara de rezidență. Autoritatea contractantă își rezerva dreptul de a rezilia unilateral acordul-cadru înainte de termen în cazul în care Ministerul Sănătății, desemnat ca unitate centralizată de achiziții, va încheia în baza O.U.G. nr. 71/2012 acorduri-cadru având ca obiect produsele din prezenta procedură.
