Departajarea ofertelor cu acelasi pret situate pe acelasi loc: in situatia in care doi sau mai multi ofertanti situati pe primul loc au acelasi pret, autoritatea contractanta va solicita clarificari prin intermediul SEAP si va solicita ofertantilor aflati in aceasta situatie sa transmita in format electronic prin SEAP o noua propunere financiara, iar acordul-cadru va fi atribuit ofertantului a carui noua propunere financiara are pretul cel mai scazut.

      3. Fara a aduce atingere prevederilor Legii nr. 182/2002 privind protectia informatiilor clasificate, cu modificarile si completarile ulterioare, operatorul economic va preciza in oferta depusa acele informatii cuprinse in propunerea tehnica si in propunerea financiara considerate a fi confidential, clasificate, protejate de un drept de proprietate intelectuala in masura in care, in mod obiectiv, dezvaluirea acestor informatii ar prejudicial interesele legitime ale operatorului economic, in special in ceea ce priveste secretul commercial si proprietatea intelectuala.
