      1. Neindeplinirea tuturor cerintelor minimale mentionate in caietul de sarcini atrage declararea ca „neconforma” a ofertei, in conformitate cu prevederile in baza art. 137 al. (2) lit. a din HG nr. 395/2016, produsul ofertat „nu satisface în mod corespunzator cerintele caietului de sarcini” si respingerea ofertei.

      2. Oferta tehnica si financiara trebuie sa contina referinte la toate specificatiile tehnice si de alta natura mentionate in caietul de sarcini, in caz contrar oferta va fi descalificata.

      3. Orice denumire comerciala mentionata in caracteristicile tehnice minimale de mai jos care ar putea individualiza un anumit producator va fi interpretata cu mentiunea „sau echivalent”.

      4. Orice descriere de procedeu tehnologic mentionat in caracteristicile tehnice minimale de mai jos care poate individualiza un procedeu patentat de un anumit producator va fi interpretat cu mentiunea „sau echivalent ca performanta si functionalitate” .

      5. In fisa tehnica ofertantul trebuie sa declare conformitatea cu cerintele impuse de specificatiile tehnice din caietul de sarcini.

      6. Ofertantul va include in propunerea financiara, toate si orice costuri legate de procurarea, furnizarea, transportul, depozitarea, punerea in functiune a echipamentelor din dotare cu reactivii ofertati si instruirea personalului, pentru utilizarea programelor noi implementete ( daca este cazul)

      7. Propunerea tehnica trebuie sa corespunda cerintelor minime prevazute in caietul de sarcini, conform art. 133 al. (2) din HG nr.395/2016.

      8. În cazul în care, pe parcursul executarii contractului de achizitie publica/acordului-cadru, se constata ca anumite elemente ale propunerii tehnice sunt inferioare sau nu corespund cerintelor prevazute în caietul de sarcini, prevaleaza prevederile caietului de sarcini, conform art. 147 (2) din HG. nr. 395/2016.

      9. Acordul cadru se incheie cu 3 promitenti furnizori, daca in urma procesului de evaluare acestia exista.

      La inceperea primului contract subsecvent, in momentul receptiei produsului in laborator furnizorul trebuie sa faca dovada conformitatii produsului (incadrarea in parametrii solicitati prin caietul de sarcini) prin testarea in laborator a fiecarui produs ce face obiectul contractului.

      Testarea produselor se face in prezenta reprezentatilor desemnati ai furnizorului si ai achizitorului si se finalizeaza prin incheierea unui proces verbal de testare, semnat de ambele parti, in care se consemneaza rezultatul testelor. in situatia in care conformitatea produsului cu cerintele caietului de sarcini nu este dovedita in urma testarii, acordul cadru inceteaza de drept cu acest promitent furnizor, achizitorul urmand sa incheie un contract subsecvent cu urmatorul promitent furnizor – daca acesta exista – procesul de testare reluandu-se si pentru contractul subsecvent in cauza. procesul de testare se repeta si pentru cel de-al treilea promitent furnizor, daca este cazul.

      10. Acordul cadrul inceteaza de drept si in urmatoarele situatii:

      — in cazul defectarii echipamentului aflat in dotarea spitalului, fara posibilitate de remediere, care functioneaza cu reactvi / alte produse ce fac obiectul acordului cadru, cauza ce face imposibila folosirea acestor produse in lipsa echipamentului.

      — Ulterior finalizarii de catre ministerul sanatatii a achizitiilor centralizate pentru produsele pentru care se realizeaza acestea (daca aceste produse fac obiectul acordului cadru).

      11. În cazul în care 2 sau mai multe oferte clasate pe primul loc au acelasi pret, atunci, în vederea incheierii acordului cadru, la solicitarea scrisa a comisiei de evaluare, transmisa on line in seap, sectiunea „intrebari”/lot, se va raspunde cu o noua oferta online sau, dupa caz, confirmarea ca se mentine pretul initial. Dupa o noua evaluare si aplicarea criteriului de atribuire, va fi declarat castigator ofertantul care a avut pretul cel mai mic.
