In cazul in care comisia constata ca au fost depuse/introduse in S.E.AP. mai mult de doua oferte admisibile cu preturi egale pentru locul 1, autoritatea contractanta va transmite prin SEAP, o solicitare de clarificare referitoare la depunerea unor noi propuneri financiare imbunatatite, iar operatorii economici vor transmite raspunsul lor folosind facilitatile oferite de S.E.A.P., caz in care contractul va fi atribuit ofertantului care are pretul cel mai scazut. În cazul pastrarii egalitatii si dupa solicitarile de clarificari referitoare la depunerea unor noi propuneri financiare imbunatatite in S.E.A.P., autoritatea contractanta va mai solicita de inca maxim 2 ori solicitare de clarificari privind imbunatatinerea propunerii financiare. Daca si in urma acestor solicitari se pastreaza egalitatea de pret, procedura de achizitie pentru lotul respectiv se anuleaza.

      Op. ec.participanti la procedura de atribuire ( candidat, ofertant, tert sustinator, subcontractant) au obigatia de a completa DUAE, instituit la nivelul UE prin Regulamentul CE nr 7/2016, versiunea electronica a documentului fiind pusa la dispozitie ca formular on-line de catre Comisia Europeana la adresa de internet https://ec.europa.eu/growth/tools-databases/espd/filter.
