   2. Additional information
      

      — Autoritatea Contractanta isi rezerva dreptul de a nu semna contractul de achizitie publica daca timpul de derulare a procedurii se prelungeste astfel incat devine imposibila incadrarea termenului de livrare in perioada de derulare a proiectului.

      — Declaratie privind calitatea de participant la procedura: completarea, semnarea si prezentarea Formularul nr. 24

      — În cazul formularii unei contestatii, în scopul de a proteja autoritatea contractanta de riscul unui eventual comportament necorespunzator, contestatorul are obligatia de a constitui garantia de buna conduita pentru întreaga perioada cuprinsa între data depunerii contestatiei/cererii/plângerii si data ramânerii definitive a deciziei Consiliului/hotarârii instantei de judecata de solutionare a acesteia.

      Contestatia/Cererea/Plângerea va fi respinsa în cazul în care contestatorul nu prezinta dovada constituirii garantiei de buna conduita.

      Garantia de buna conduita se constituie prin virament bancar sau printr-un instrument de garantare emis în conditiile legii de o societate bancara ori de o societate de asigurari si se depune în original la sediul autoritatii contractante si în copie la Consiliu sau la instanta de judecata, odata cu depunerea contestatiei/cererii/plângerii.

      Garantia de buna conduita trebuie sa aiba o perioada de valabilitate de cel putin 90 de zile, sa fie irevocabila si sa prevada plata neconditionata la prima cerere a autoritatii contractante, în masura în care contestatia/cererea/plângerea va fi respinsa ca inadmisibila.

      În cazul în care, în ultima zi de valabilitate a garantiei de buna conduita, decizia Consiliului sau hotarârea instantei de judecata nu este ramasa definitiva, iar contestatorul nu a prelungit valabilitatea garantiei de buna conduita în conditii mai sus mentionate autoritatea contractanta va retine aceasta garantie.

      Prevederile de mai sus se aplica în mod corespunzator si în situatia în care plângerea împotriva deciziei Consiliului este formulata de o alta persoana decât autoritatea contractanta sau contestator.

      — Autoritatea contractanta va restitui garantia de buna conduita conform prevederilor art. 271/2 alin. (4) si (5) din OUG nr. 34/2006 cu modificarile si completarile ulterioare.
