      Raspunsurile la clarificarile solicitate de operatorii econimici – însotite de întrebari se vor publica pe SEAP (Sistemul Electronic de Achizitii Publice – www.e-licitatie.ro), într-un document atasat la anuntul de participare. Clauzele contractuale sunt prezentate în modelul de contract de furnizare. Prin depunerea ofertelor, operatorii economici îsi însusesc continutul acestuia, inclusiv al raspunsurilor la solicitarile de clarificari, atasate la anuntul de participare, daca este cazul. Modul de departajare a ofertelor cu preturi egale: in cazul în care comisia de evaluare constata ca ofertele admisibile cu pretul cel mai mic au preturi egale, se va solicita acestora o noua propunere financiara care se va depune în aceleasi conditii ca si oferta.

      Informatii privind asocierea: Operatorii economici au dreptul de a se asocia cu scopul de a depune oferta comuna. Într-o astfel de situatie, se va prezenta acordul de asociere din care vor rezulta cel putin urmatoarele: – faptul ca asociatii sunt responsabili solidar si nelimitat de executarea contractului; – nominalizarea liderului asociatiei; – comunicarile se vor face cu liderul asociatiei; – platile se vor face catre liderul asociatiei; – partea/partile din contract urmeaza sa fie îndeplinita/ îndeplinite de fiecare asociat în parte; Fiecare asociat va completa DUAE. Odata cu depunerea DUAE vor prezenta acordul de asociere (impreuna cu documente anexe la angajament, transmise acestora de catre asociati, din care rezulta modul efectiv in care se va materializa sustinerea acestuia/ acestora). Documentele justificative care probeaza cele asumate in angajamente/ acorduri vor fi solicitate doar ofertantului declarat castigator, la solicitarea autoritatii contractante.

      În cazul în care un grup de operatori economici depun o oferta comuna, atunci capacitatea tehnica si/sau profesionala sau situatia economico-financiara se demonstreaza prin luarea în considerare a resurselor tuturor membrilor grupului. De asemenea, documentele de calificare de la pct. III.2.1.a) si III.2.1.b), vor fi prezentate de catre fiecare din membrii asociatiei, iar celelalte documentele de calificare vor fi prezentate pentru tot grupul asociat. Oferta tehnica si financiara va fi prezentata ca document comun semnat de liderul asociatiei. Asocierea va fi demonstrata prin prezentarea unui acord de asociere. În cazul în care o oferta comuna, va fi declarata câstigatoare, membrii grupului au obligatia de a-si legaliza asocierea înainte de semnarea contractului.
