      Departajarea ofertelor cu preturi egale: In cazul in care in urma etapei finale de licitatie electronica, 2 sau mai multi ofertanti sunt clasati pe primul loc, avand acelasi pret, AC va solicita numai acelor ofertanti depunerea de noi oferte de pret, in SEAP. Ofertantii nu vor avea decat dreptul de a imbunatati preturile ofertate anterior, urmand ca oferta al carei nou pret (reofertat) este cel mai scazut sa fie declarata castigatoare. Daca si in urma reofertarii, ofertantii nu vor putea fi departajati, vor deveni incidente prevederile art. 212 alin. (1) lit. c) din Legea nr. 98/2016, fiind imposibila incheierea contractului.

      2) Elemente de confidentialitate: Ofertantul va elabora oferta in conformitate cu prevederile documentatiei de atribuire si va indica, motivat, in cuprinsul acesteia, care informatii din propunerea tehnica si/sau propunerea financiara sunt confidentiale, clasificate sau sunt protejate de un drept de proprietate intelectuala conform legislatiei aplicabile.

      3) AC are dreptul sa solicite in original orice document cu regim special a carui valabilitate este conditionata de prezentarea in aceasta forma.

      4) Conform prevederilor art. 196 alin. (1) din Legea nr. 98/2016, AC poate solicita ofertantilor sa depuna toate sau o parte dintre documentele justificative ca dovada a informatiilor cuprinse in DUAE, in orice moment pe durata desfasurarii procedurii, daca acest lucru este necesar pentru a asigura desfasurarea corespunzatoare a procedurii.
