      Perioada de valabilitate a ofertelor 60 zile de la termenul limita de depunere a ofertelor.

      Note:

      a) entitatea contractanta are dreptul de a solicita ofertantilor, in circumstante exceptionale, inainte de expirarea perioadei de valabilitate a ofertei, prelungirea acestei perioade.

      b) ofertantul are obligatia de a comunica entitatii contractante daca este sau nu este de acord cu prelungirea perioadei de valabilitate a ofertei.

      c) ofertantul care nu este de acord cu prelungirea perioadei de valabilitate a ofertei se considera ca si-a retras oferta, fara ca acest fapt sa atraga pierderea garantiei de participare.

      Limba de redactare a ofertei – romana.

      Toate certificatele si documentele emise in alta limba decat romana vor fi insotite de traducerea autorizata. In cazul in care operatorii economici participanti la procedura de atribuire uzeaza de drepturile prevazute la art. 193 din Legea 98/2016 prin completarea DUAE, documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantul clasat pe locul I.

      Operatorii economici pot accesa DUAE in vederea completarii formularului on-line prin intermediul site-ului – https://ec.europa.eu/growth/tools-databases/espd/filter si cu link-ul https://ec.europa.eu/tools/espd

      Solicitarile de clarificari ale potentialilor ofertanti se vor adresa in mod exclusiv in SEAP la Sectiunea ”Intrebari” din cadrul procedurii de atribuire derulate prin mijloace electronice iar raspunsurile la acestea vor fi publicate in SEAP, la Sectiunea ”Documentatie si Clarificari” din cadrul anuntului de participare, entitatea contractanta urmand sa nu dea curs solicitarilor adresate prin alta modalitate de comunicare decat cea stabilita in conformitate cu prevederile art. 64 alin. (1) din Legea nr. 98/2016 pentru comunicarile ulterioare depunerii ofertelor.

      Comisia de evaluare va transmite solicitarile de clarificare privind ofertele depuse, in SEAP la Sectiunea “Intrebari”.

      Operatorii economici vor transmite raspunsurile la clarificari si eventualele documente solicitate pe parcursul evaluarii ofertelor prin intermediul SEAP (Sectiunea “Intrebari”), integral in sectiunea corespunzatoare respectivei solicitari, sub forma unuia sau a mai multor documente/fisiere distincte semnate cu semnatura electronica.

      In cazul in care se constata ca ofertele clasate pe primul loc au preturi egale, in vederea departajarii ofertelor, entitatea contractanta (prin intermediul SEAP la Sectiunea “Intrebari”) va solicita reofertarea, prin prezentarea unei noi propuneri financiare.

      Noua propunere financiara va fi depusa doar si numai in urma solicitarii entitatii contractante. Ofertantul va prezenta o declaratie prin care accepta clauzele contractuale cuprinse în modelul de contract din documentatia de atribuire. In situatia în care sunt obiectiuni la proiectul de contract respectiv modificari ale clauzelor contractuale sau adaugarea unor clauze noi, eventualele propuneri de modificare/completare/eliminare de clauze contractuale vor fi formulate în scris cu justificari si înaintate cu documentele de calificare.

      Daca propunerile sunt dezavantajoase pentru AC aceasta isi rezerva dreptul de a le respinge informând ofertantul. Daca ofertantul nu renunta la aceste clauze AC va încadra oferta ca neconforma si o va respinge. Pentru accesul la datele de identificare ale participantilor la procedura se va complete DUAE in care se vor inscrie toate datele de identificare ale operatorului economic (adresa sediu, CUI, nr. de inregistrare la Of. Reg. Comertului, nr. de telefon, fax, e-mail, principala piata a afacerilor).
