      Departajarea ofertelor cu acelasi pret. In situatia in care doi sau mai multi ofertanti au acelasi pret total, comisia de evaluare va solicita noi propuneri prin intermediul SEAP (la sectiunea intrebari). In solicitare se va indica locatia si data pana la care vor fi transmise noile propuneri financiare.

      Documentele solicitate prin documenatatia de atribuire sunt obligatorii. Se vor solicita completari si clarificari doar la documentele depuse.

      Se va prezenta Formularul 3 din capitolul III Formulare, in vederea insusirii clauzelor contractuale specifice. Neprezentarea Formularului 3 la data depunerii ofertelor se considera acceptare tacita de catre ofertant a clauzelor contractuale, acestea nemaiputand fi modificate ulterior. Orice operator economic are dreptul de a solicita clarificari cu privire la continutul documentatiei de atribuire si implicit si cu privire la clauzele contractuale obligatorii (ce sunt parte a documentatiei de atribuire).

      Daca un operator economic considera ca anumite clauze sunt defavorabile, va solicita autoritatii contractante clarificari, inclusiv modificarea lor, astfel incat daca aceste clauze vor fi amendate/modificate, ele sa fie aduse la cunostinta tuturor operatorilor economici interesati pana la data limita de depunere a ofertelor. Clauzele obligatorii pot fi modificate cu respectarea prevederilor art. 143 alin. (3) lit. b) din Hotararea 394/2016 si aduse la cunostinta tuturor celor interesati pana la data limita de depunere a ofertelor.

      Clauzele specifice ale contractului pot fi negociate/modificate cu acceptul autoritatii contractante daca propunerile sunt justificate sau in conformitate cu anumite obligatii prevazute de legislatia in vigoare si daca nu introduc conditii care ar fi permis atribuirea contractului unui alt operator economic sau daca modificarea nu schimba balanta economica a contractului in favoarea contractantului.

      La luarea hotararii privind atribuirea contractului, se va considera faptul ca aceste clauze contractuale sunt studiate, analizate si acceptate de catre ambele parti contractuale.
