      În cazul în care exista oferte cu preturi egale, pentru ofertele clasate pe primele 3 locuri, autoritatea contractanta va solicita clarificari prin intermediul SEAP în vederea încărcării electronice de catre operatorii economici de documente care contin noi preturi, fara ca aceastea sa afecteze pozitiile superioare in clasament ocupate de ceilalti ofertanti. Documentele justificative care probeaza îndeplinirea celor asumate prin completarea DUAE urmeaza a fi prezentate, la solicitarea autoritatii contractante, doar de catre ofertantii clasati pe primele 3 locuri in clasamentul intermediar intocmit la finalizarea evaluarii ofertelor.

      Conform Legii 98/2016, ofertantul este obligat sa utilizeze DUAE (Document Unic De Achizitie European) — Versiunea DUAE este pusa la Dispozitie ca si formular online de catre Comisia Europeana, la adresa de internet dedicata — https://ec.europa.eu/growth/tools-databases/espd/filter.

      Prezentul acord-cadru inceteaza de drept, pentru acele medica licitate si adjudecate la nivel national de catre M.S. desemnat ca unitate de achizitii centraliz. conform O.U.G. nr. 71/2012 si a ordinului nr. 1292/18.12.2012 aferent si care sunt cuprinse in prezentul acord-cadru.
