      Modul de departajare a ofertelor cu prețuri egale: pentru fiecare lot în parte.

      În cazul ofertelor cu prețuri egale (două sau mai multe oferte) și clasate pe același loc, modul de departajare între oferte se va face prin reofertarea prețurilor. Prețul reofertat nu poate fi îmbunătățit decât până la nivelul prețului ofertat de operatorul clasat pe locul anterior.

      În cazul în care comisia de evaluare constată ca au fost depuse oferte admisibile cu prețuri unitare egale la ofertanții clasați pe primul loc, autoritatea contractantă va solicita reofertarea prețurilor, caz în care contractul va fi atribuit ofertantului al cărui nouă propunere financiară are prețul cel mai scazut.

      În cazul reofertării, prețul unitar poate fi ofertat cu 3 zecimale ținându-se cont de împachetare, astfel încat prețul pe cutie să fie cu două zecimale.

      În cazul în care după reofertare pentru ofertele clasate pe primul loc prețurile unitare sunt egale, autoritatea contractantă va respinge ofertele respective ca inacceptabile, devenind astfel câștigatoare oferta clasată pe următorul loc sau în cazul în care nu există altă ofertă admisibilă va anula lotul respectiv.

      Prezentul acord-cadru se reziliază pe deplin drept în eventualitatea realizării licitației în conformitate cu OUG.71/2012, efectuat de Ministerul Sănătății la nivel national.
