      Acordul-cadru se va încheia cu maxim 3 operatori economici, în măsura în care există suficienți ofertanți eligibili participanți la procedură. Dacă numărul participanților eligibili este de 2 sau 1 atunci acordul-cadru se va încheia după caz cu aceștia. Ofertantul își asumă răspunderea exclusivă pt. legalitatea și autenticitatea tuturor documentelor prezentate în original și/sau în copie în vederea participării la procedură. Analizarea documentelor prezentate de către ofertanți, comisia de evaluare nu angajează din partea acesteia nicio răspundere sau obligație față de acceptarea ca fiind autentice sau legale și nu înlătură răspunderea exclusivă a ofertantului sub acest aspect.

      Modul de departajare a ofertelor cu prețuri egale. Pentru fiecare lot în parte:

      1) În cazul ofertelor de preț egale (2 sau mai multe oferte) și clasate pe același loc, modul de departajare între oferte se va face prin reofertarea prețurilor în SEAP. Prețul reofertat nu poate fi îmbunătățit decât până la nivelul prețului ofertat de operatorul clasat pe locul anterior;

      2) În cazul în care comisia de evaluare constată că au fost depuse oferte admisibile cu prețuri unitare egale la ofertanții clasați pe primul loc, autoritatea contractantă va solicita o nouă propunere financiară în SEAP. Clasamentul se va stabili în urma reofertării prețurilor. În cazul menținerii egalității de prețuri:

      (a) În cazul în care se menține egalitatea de prețuri pe primul loc, atunci întregul lot se anulează,

      (b) În cazul în care se menține egalitatea de prețuri pe locurile 2 sau 3, atunci se anulează locurile 2 și/sau 3.

      În situația în care ofertele clasate pe locul 3 au prețuri egale, autoritatea contractantă va solicita în scris prin intermediul SEAP o nouă oferta de preț, îmbunătățirea ofertei să nu fie mai mică sau egală cu cea clasată pe locul 1 sau 2. În situația în care ofertele clasate pe locul 2 au prețuri egale, autoritatea contractantă va solicita în scris prin intermediul SEAP o nouă ofertă de preț, îmbunătățirea ofertei să nu fie mai mică sau egală cu cea clasată pe locul 1. În situația în care ofertele clasate pe locul 1 au prețuri egale, autoritatea contractantă va solicita în scris prin intermediul SEAP o nouă ofertă de preț. Ofertantul va elabora oferta în conformitate cu prevederile din documentația de atribuire și va indica în cuprinsul acesteia care informații din propunerea tehnică și/sau din propunerea financiară sunt confidențiale, clasificate sau sunt protejate de un drept de proprietate intelectuală. Documentele se semnează cu semnătura electronică extinsă, bazată pe un certificat calificat, eliberat de un furnizor de servicii de certificare acreditat, reprezentând documente originale, valabilă la momentul prezentării.

      Cantitățile sunt estimate și vor fi comandate în funcție de banii alocați.

      Nota: specificațiile tehnice care indică o anumită origine, sursă, producție, un procedeu special, o marcă de fabrică sau de comerț, un brevet de invenție, o licență de fabricație, sunt menționate doar pentru identificarea cu ușurință a tipului de produs și nu au ca efect favorizarea sau eliminarea anumitor op. economici sau a anumitor produse, aceste specificații vor fi considerate ca având și mențiunea de „sau echivalent’’ (art. 56 din Legea 98/2016). Ofertantul va elabora oferta în conformitate cu prevederile din documentația de atribuire și va indica în cuprinsul acesteia care informații din propunerea tehnică și/sau din propunerea financiară sunt confidențiale, clasificate sau sunt protejate de un drept de proprietate intelectuală.

      Autoritatea contractantă iși rezervă dreptul de a rezilia unilateral acordul-cadru înainte de termen în cazul în care Ministerul Sănătății va încheia în baza OUG 71/2012 acorduri-cadru având ca obiect produsele din prezenta procedură.
